These terms are the agreement between you and [LEGAL ENTITY]
("Pagenail", "we") covering the Pagenail browser extension, the web app, and
this website. Installing or using any of them means you accept them.
Pagenail is a browser extension that attaches notes you write to the addresses of web pages, so they're waiting for you when you return. Your notes are stored by your own browser on your own device. An optional account copies them to our server so they survive a reinstall and appear on another machine.
Pagenail is a note-taking tool, not a backup service and not an archive. It keeps what you type; it does not keep a copy of the pages you were reading. Treat it accordingly, and keep your own copies of anything you can't afford to lose — exports and backups exist for exactly that.
Most of Pagenail needs no account and no agreement about data with us at all: your notes never reach us. What that means practically is that we cannot recover them for you. Removing the extension deletes them, and so does clearing your browser's data for it. Take a backup first.
You may create an account if you:

One limitation to know before you rely on an account: there is currently no password reset and no way to change the email address on an account. If you lose the password, there is no recovery path today. We'll do this by hand if you write to us.
Don't use Pagenail to:
If you do, we may suspend or close your account. Where the problem is minor and fixable we'll ask you to fix it first; where it isn't, or where leaving it alone would put others at risk, we may act immediately.
You keep every right you have in what you write. We claim no ownership of your notes.
To run the service for you, we need your permission to do the obvious mechanical things with the notes you sync: store them, back them up, transmit them between your devices, and display them back to you. That permission is limited to operating Pagenail, lasts only as long as you keep the notes with us, and ends when you delete them. We don't use your notes to train machine-learning models, and we don't use them to advertise to you.
Sharing is public. When you create a share link, anyone who has that link can read the note and see which page it came from. Don't share anything you need to keep private.
Pagenail is free to use today, and nothing in the extension is behind a paywall. We have not committed to it being free forever.
If we introduce a paid plan, we'll say so clearly and in advance, and these terms will gain the billing detail — cycle, renewal, refunds, price changes — before anyone is charged anything. Two commitments now, so nobody has to worry about them later: we won't start charging for something you're already using without telling you first, and your existing notes will stay readable and exportable regardless of what plan you're on.
Pagenail is provided as it is, without a service level agreement or an uptime guarantee. We may change, suspend or discontinue parts of it.
The local part of Pagenail doesn't depend on us being up: notes on your own device keep working whether or not our server is reachable. Sync and sharing do depend on it. If we ever discontinue the service entirely, we'll give reasonable notice by email to account holders and keep exports working through the notice period, so nobody's notes are stranded.
You can stop at any time: remove the extension, or ask us to delete your account. Export anything you want to keep first — closing an account deletes the notes stored with it.
We may close your account if you breach these terms, or if we stop offering the service. Except where the breach makes it inappropriate, we'll give you a reasonable opportunity to export your notes before the account goes.
Pagenail is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that it will be uninterrupted, error-free, or that it will keep every note in every circumstance.
Nothing here limits rights you have under consumer law that cannot be limited by agreement.
To the fullest extent the law allows, Pagenail is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, or lost or corrupted data, arising out of your use of the service.
Where liability cannot be excluded, our total liability to you for all claims
is limited to [LIABILITY CAP].
We may update these terms. The date at the top changes when we do. For a change that materially affects your rights, we'll notify account holders by email rather than relying on you to notice, and continuing to use Pagenail after a change takes effect means you accept it. If you don't, stop using it and ask us to close your account.
These terms are governed by the laws of [JURISDICTION], and
disputes will be heard by the courts of [COURTS], except where
the law where you live gives you the right to bring a claim locally.
